Choosing a forum for a cross-border dispute

Governing law, jurisdiction, arbitration, evidence, interim relief and enforcement should be compared before filing.

Updated October 2026 · Approximately 6 minutes · General information only

01

Separate law from forum

A clause selecting governing law does not necessarily select the court or arbitral seat. Read the complete agreement, incorporated terms, amendments and notice provisions. Identify inconsistencies before taking a position.

02

Check jurisdiction and gateway questions

Consider the parties, place of performance, location of harm, submission clauses and any mandatory rules. In the UAE, onshore and relevant free-zone court structures may require careful analysis of jurisdiction and procedure.

03

Compare court and arbitration routes

Evaluate confidentiality, decision-maker expertise, appeal, interim measures, evidence access, cost, language, timing and enforceability. The best clause in a new contract may differ from the best available route after a dispute.

04

Plan urgent and parallel action

Asset movement, evidence loss, continuing publication or misuse may require interim relief. Determine whether relief is available in the chosen forum or where assets and evidence sit, and manage the risk of inconsistent parallel steps.

05

Work backwards from enforcement

Identify where the counterparty and assets are located and what recognition process may apply. A successful decision has limited value if it cannot be translated into practical recovery or compliance.
